What is the Volvo Emissions Scandal?

Murmurs of Volvo’s involvement in the dieselgate scandal first broke in 2015 when all eyes were on the automotive industry after the Volkswagen scandal. Data obtained by The Guardian found that Volvo’s diesel vehicles were emitted substantially higher levels of pollution when tested in more realistic driving conditions, compared to the usual lab scenario.

The data showed that the Volvo S60 D4 emitted an incredible 14 times more emissions on the road than when tested by regulators.

The European Commission then invited Volvo to take part in an investigation into diesel emissions in 2016. As part of that investigation, Volvo admitted to using defeat devices called “Thermal Windows”.

Many manufacturers, including Volvo, have stated these types of defeat devices are permissible by law due to an exemption which allows the use of defeat devices provided they are for the purpose of “protecting the engine against damage or accident and for safe operation of the vehicle”.

However, the Court of Justice of the European Union recently hit back, and stated:

…in order to be justified, the presence of such a device must allow the engine to be protected against sudden and exceptional damage.

The key here is “sudden and exceptional damage”. The exemption is unlikely to cover long term degradation of vehicle components.
