The Facts of the Emissions Scandal
Tests in the USA on Volkswagen cars have shown that their vehicles emitted 10 to 40 times more pollution than first expected.
Figures suggest that these vehicles could be responsible for 237,000-948,000 tonnes of NOx emissions each year – For comparison, the UK power station, Drax, emits 39,000 tonnes a year.
NOx contributes to various respiratory diseases, cancer, acid rain and smog. Pollution from cars is the biggest contributor to NOx in our air.
The WHO estimated that in 2016, 600,000 children died from acute lower respiratory infections caused by polluted air
In April 2020, the UK High Court ruled that VW did indeed install devices to cheat emissions tests, despite VW denying claims.
Tests have shown that cars that have been “fixed” have worse fuel economy afterwards.

What is the emissions scandal?
The emissions scandal has grown over the last couple of years to encompass much more than one manufacturer. It was Volkswagen, however, that was the first car giant to be uncovered.
In 2015, Volkswagen admitted to fitting 11 million of its vehicles with a “cheat device” after the United States Environmental Protection Agency (EPA) had found that their cars had cheated emissions tests . Of the 11 million, it said 8.5 million were in Europe, with 1.2 million being in the UK. At the time, the car maker incurred $33 billion in regulatory fines, compensation payouts and buyback schemes.

How does the defeat device work?
The defeat device in question is clever. It detected when an VW emissions test was being conducted and operated the vehicle in a special low emissions mode. This meant that the VW’s real world emissions were actually much higher than the tests could find.
Fast forward to 2021, and many, many more manufacturers are beginning to be caught out. Each defeat device technology is different across different car makers, but the end result is similar – real world emissions by these vehicles are a lot higher than the laboratory tests and, therefore, a lot higher than what was promised when purchasing the car. We believe this is wrong and you are entitled to compensation if you have been lied to.
